Untersbergbahn Terms and Conditions of Carriage
- The Conditions of Carriage are an integral part of the contract of carriage. They apply to the carriage of passengers and property, as well as to conduct on railway premises.
- The contract of carriage begins when the passenger passes through the turnstile and ends when the passenger exits the turnstile at the opposite station; if no such turnstile exists, the contract ends when the passenger exits the vehicle. In addition, the rules of conduct set forth in the Terms and Conditions of Carriage apply from the moment the passenger enters the cable car area until the moment of departure, based on the operator’s right to manage the premises.
- By purchasing a ticket, the passenger acknowledges the following terms and conditions and agrees to comply with them.
- A violation of the terms and conditions of carriage may also result in liability under the law.
- The cable car company is obligated to provide transportation in accordance with the schedule if
- the applicable laws and regulations, the terms and conditions of carriage, and the cable car company’s instructions issued in the interest of safety and order are complied with,
- the transport is not prevented by circumstances that the cable car company cannot avert and is unable to remedy, or
- passenger service is not suspended due to maintenance or renovations.
- Persons who are intoxicated, or who fail to comply with the provisions of these Terms and Conditions of Carriage or with any additional instructions issued by the cable car company to ensure safety and order, or who are obviously unable to do so due to their physical or mental condition, are prohibited from riding.
- Passengers must have a valid ticket. As a general rule, tickets are non-transferable; exceptions are specified in the fare schedule. The validity period of the tickets is indicated on the ticket itself or specified in the fare schedule.
- The ticket must be presented upon request for inspection or validation. If the ticket is in such a condition that its validity can no longer be determined, a new ticket must be purchased.
- If transportation is not provided for reasons attributable to the cable car company or in accordance with Section 5(b), the fare will be refunded upon request. If transportation is not provided for reasons attributable to the passenger, there is no entitlement to a refund of the fare.
- The following rules apply to passengers’ conduct before, during, and after transportation:
- Passengers must conduct themselves in a manner that does not endanger the safety of the cable car operation or the passengers, and that does not disrupt order or the smooth operation of the facility.
